1. Acceptance of Terms

By accessing the ZyntroTest website (zyntrotest.com) or using our analytical testing services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our website or services.

These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and ZyntroTest ("we," "our," or "us").

2. Services

ZyntroTest provides analytical testing services including, but not limited to:

• Peptide purity and identity analysis via LCMS
• Supplement and nutraceutical screening
• Biotech research and development sample analysis
• Custom analytical method development
• Certificate of Analysis (COA) generation and delivery

All services are subject to availability and may be modified or discontinued at our discretion with reasonable notice.

3. Sample Submission

By submitting samples to ZyntroTest, you represent and warrant that:

• You have the legal right to submit the samples for testing
• The samples comply with all applicable federal, state, and local laws
• You have accurately described the sample contents and any known hazards
• The samples are properly packaged and labeled according to our guidelines

ZyntroTest reserves the right to refuse any sample that we believe poses a safety risk, violates applicable law, or falls outside the scope of our testing capabilities.

4. Pricing and Payment

• Pricing for services is provided via quote based on your specific testing requirements.
• Payment is due upon receipt of invoice and must be received before testing begins, unless alternative payment terms have been arranged in writing.
• We accept bank transfers, checks, and major credit cards.
• Net 30 payment terms may be available for established accounts upon approval.
• All prices are quoted in U.S. Dollars (USD).
• Prices are subject to change; however, quoted prices will be honored for 30 days from the date of the quote.

5. Turnaround Times

Standard turnaround times are 3-10 business days from the date of sample receipt, depending on the type of analysis. Rush services (24-48 hours) are available for an additional fee.

Turnaround times are estimates and not guarantees. ZyntroTest is not liable for delays caused by equipment maintenance, supply chain disruptions, force majeure events, or other circumstances beyond our reasonable control.

6. Results and Certificates of Analysis

• All test results are provided in the form of a Certificate of Analysis (COA).
• Results reflect the condition of the sample as received and tested.
• COAs are retained for a minimum of 5 years.
• Results are confidential and will only be shared with the submitting client unless otherwise authorized in writing.

7. Limitation of Liability

ZyntroTest's liability for any claim arising from our services shall not exceed the total fees paid by the Client for the specific testing service giving rise to the claim.

In no event shall ZyntroTest be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Decisions made based on test results
• Damages arising from the use or inability to use our website

Our testing services are provided for informational and analytical purposes. Clients are responsible for interpreting results in the context of their specific applications and regulatory requirements.

8. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive for the highest accuracy in our analytical work, we do not warrant that results will be error-free or that our website will be uninterrupted or free of viruses or other harmful components.

9. Sample Retention and Disposal

Unless otherwise agreed in writing:

• Samples are retained for 30 days after delivery of results
• After the retention period, samples are disposed of in accordance with applicable regulations
• Clients may request sample return at their expense within the retention period
• ZyntroTest is not responsible for sample degradation during storage

10. Intellectual Property

All content on the ZyntroTest website, including text, graphics, logos, images, and software, is the property of ZyntroTest and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

11. Confidentiality

We treat all client information, sample details, and test results as confidential. We will not disclose your information to third parties except as required by law or as described in our Privacy Policy.

12. Indemnification

You agree to indemnify and hold harmless ZyntroTest, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Force Majeure

ZyntroTest shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power failures, equipment failures, or supply chain disruptions.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Brazos County, Texas.

15. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
